Employing an international and comparative analysis of international law as well as the domestic legal regimes of selected jurisdictions, i.e., China, South Africa and South Australia, Water Rights - An International and Comparative Study identifies the essential elements a well-structured water rights system, which ensures that the multiple functions of water resources are reasonably balanced, and the competing water needs are properly taken into consideration, and under which the economic, social and environmental values of water resources co-exist equitably in harmony. This book is the first to discuss water rights holistically, i.e., putting the three aspects of water rights (the property right of water resources, the human right to water and the environmental right to water) into a single, well-organised water rights system under the principle of sustainable development. Following the Introduction, Water Rights has six chapters. Chapter Two develops an analytical approach to be applied in the following four chapters. Ours has been called a global "age of rights," an era in which respect for human rights is considered the highest aspiration of the international democratic community. Since the United Nation's 1948 Universal Declaration of Human Rights, a wide variety of protections -- civil, political, economic, social, and cultural -- have been given legal validation as countries ratify treaties, participate in intergovernmental organizations, and establish human rights tribunals and truth and reconciliation commissions. Yet notable human rights failures have marred the post-Declaration era, including ongoing state violence toward citizens, the selectivity of humanitarian intervention (evidenced by the international community's failure to respond in Rwanda), and recent legislation in advanced democracies that trades some rights for protection against the threat of terrorism. How are we to reconcile the language of rights with the reality? Do we live in an age of rights after all? In Protecting Human Rights, Todd Landman provides a unique quantitative analysis of the marked gap between the principle and practice of human rights. Applying theories and methods from the fields of international law, international relations, and comparative politics, Landman examines data from 193 countries over 25 years (1976-2000) to assess the growth of the international human rights regime, the effect of law on actual protection, and global variation in human rights norms. Landman contends that human rights foreign policy remains based more on geo-strategic interest than moral internationalism. He argues that the influence human rights ideals have begun to have on states cannot be separated from the broader impact of socioeconomic changes that swept the globe in the late twentieth century. This volume continues the work of the International Academy of Estate and Trust Law in 2003 and 2004 in examining through the juxtaposition of civil and common law jurisdictions areas of fundamental importance to estate and trust lawyers internationally. Here we focus upon two themes: the definition of `family and the impact of the expansion of the concept of `family in law; and family fights over wills and estates - what recourse family members may have in challenging an estate. Each theme also has contained within it the continuing struggle between `private and `public: what responsibilities should be shouldered privately, within `the family, and what responsibilities are properly those to be borne by the state? The definition of family lies at the heart of this struggle - because with each expansion of the definition comes an expansion of responsibility in the private arena; but, at the same time, a public recognition of relationships having consequences - expanding definitions of family are necessarily normative in this sense. The first Part, `The Challenge of the New Family for Law, considers the `challenge both in the inter vivos and the postmortem contexts in the United States, Canada, France, the United Kingdom, Australia and New Zealand. A particular focus is upon the dramatic expansion of the definition of family from the `traditional nuclear family consisting of a husband, wife and their mutual children to a definition that includes unmarried heterosexual and same sex couples living together and, in some jurisdictions to new kinds of companionate partnerships that are not based on a sexual relationship. In some jurisdictions such developments are simply an expression of sharing responsibility by allocating it in the private domain, as opposed to the public potentially through social welfare; in others, particularly in the United States, it is a flashpoint a defence of fundamental institutions and, with it, a defence of society itself. The second Part, Family Fights over Wills and Estates, examines the law in Australia, Switzerland, France, Mexico, and the United Kingdom. In its comparison of civil and common law approaches we see how the law expresses the same principle objects - protection of family and obligations towards key family members - but does so from entirely different perspectives; and where the common law which enshrined the notion of testamentary freedom is being qualified through the expanding domain of family provision legislation, the civil law which is based on codified shares and allocated responsibilities expressed through proportionate entitlements in estates, is being qualified through a range of disqualifying and varying mechanisms. This volume is the fifth of the published deliberations of the International Academy of Estate and Trust Law. In a work of prodigious scholarship and enormous breadth, which draws on the tribal, ancient, premodern, and modern worlds, Orlando Patterson discusses the internal dynamics of slavery in sixty-six societies over time. These include Greece and Rome, medieval Europe, China, Korea, the Islamic kingdoms, Africa, the Caribbean islands, and the American South. Slavery is shown to be a parasitic relationship between master and slave, invariably entailing the violent domination of a natally alienated, or socially dead, person. The phenomenon of slavery as an institution, the author argues, is a single process of recruitment, incorporation on the margin of society, and eventual manumission or death. Distinctions abound in this work. Beyond the reconceptualization of the basic master-slave relationship and the redefinition of slavery as an institution with universal attributes, Patterson rejects the legalistic Roman concept that places the "slave as property" at the core of the system. Rather, he emphasizes the centrality of sociological, symbolic, and ideological factors interwoven within the slavery system. Along the whole continuum of slavery, the cultural milieu is stressed, as well as political and psychological elements. Materialistic and racial factors are deemphasized. The author is thus able, for example, to deal with "elite" slaves, or even eunuchs, in the same framework of understanding as fieldhands; to uncover previously hidden principles of inheritance of slave and free status; and to show the tight relationship between slavery and freedom. Interdisciplinary in its methods, this study employs qualitative and quantitative techniques from all the social sciences to demonstrate the universality of structures and processes in slave systems and to reveal cross-cultural variations in the slave trade and in slavery, in rates of manumission, and in the status of freedmen. So devastating was the Black Death across the Old World that some historians have compared its effects to those of a nuclear holocaust. As countries began to recover from the plague during the following century, sharp contrasts arose between the East, where societies slumped into long-term economic and social decline, and the West, where technological and social innovation set the stage for Europe's dominance into the twentieth century. Why were there such opposite outcomes from the same catastrophic event? In contrast to previous studies that have looked to differences between Islam and Christianity for the solution to the puzzle, this pioneering work proposes that a country's system of landholding primarily determined how successfully it recovered from the calamity of the Black Death.
