The primary purpose of a tax is to fund governmental activity, however, the purposes of governmental activities may be broadly defined. Along with funding the necessities of government, the purpose of taxation frequently expands to include economic and social objectives. Taxes may be used as a method for developing a strong, vibrant economy by fostering or limiting certain businesses, or they may be used as a means of redistributing wealth and encouraging social reform. Taxes have been a part of society from the time the first governments developed. Payment of animal skins to a chief, who could use the animal skins to buy weapons which he would use to supply warriors who would defend the village, was a type of primitive tax. Taxes have been used by governments to pay for public works, fund wars, control economies through tariffs on imports and exports, and, sadly, fill the coffers of rulers at the expense of the ruled. Some of the oldest records of civilization tell of taxes. The following examples are by no means complete but indicate how long taxes have been a part of people's economic lives: 2000 BC, clay records discovered in Iraq tell of onerous taxes. 1400 BC, Egyptian records detail subjects paying taxes to their Pharaoh. 600 BC, the first graduated income tax was in use in Greece. 300 BC, the Ptolemy dynasty of Egypt instituted various taxes, including tariffs on imports, poll taxes on salt, legal documents, sales and rental of goods, fees for grazing cattle on state land, and a tax on produce. 125 BC, tax collection in the Roman Empire is a well established system. 1050 AD, the story of Lady Godiva highlights a tax protest in England. 1427, income and property taxes are instituted in Florence, Italy. 1450, in Mexico taxes could be paid to the Aztec government in the form of exotic feathers. 1643, a faculty tax is adopted in New Plymouth, Massachusetts. A precursor of income taxes, a faculty tax was applied to a person's "faculties," his or her ability to earn income from property, trade, or a skill. In time most of the colonies were to establish faculty taxes. 1793, the first general income tax is established in France.

The 2010 decision is this: The U.S. Congress made the tax consequences of death in 2010 frighteningly complex by making executors decide which of two options would apply. Either: - The estate tax must be paid and the income tax basis of the estate’s assets will be equal to fair market value as of date of death, or - by election of the executor, the estate tax (and only the estate tax) will be avoided while the income tax basis of each estate asset will be the lesser of the decedent’s cost basis or fair market value as of date of death (a limited amount of basis increase may be had). But which is best? That depends on each situation, so a thorough understanding of each estate’s facts, familiarity with the intricacies of the new rules, and careful analysis are indispensible. Think the decision is simple for estates under $5 million? Not always. And there are other rules that come into play besides modified carryover basis, if the election out of the estate tax is made. The IRS announced it will give a “reasonable amount of time” to file the election, once the forms and guidance are published (neither has been released as of this writing). Family Tax Law is organized around family law topics that also raise serious tax law issues. Its goal is to serve both the family law and tax law academic communities by providing a text book that links family law issues with related tax law problems. The book covers federal income tax issues concerning the formation and dissolution of family structures. It continues with chapters that address children, education, family health, family home and other family topics, along with the federal tax issues that accompany them. The first chapter provides a review of basic tax law principles sufficient to allow non-tax students to proceed with the family tax law materials that follow. Family Tax Law supports a family law curriculum by providing detailed illustrations and problems concerning family law topics and the associated federal income taxation issues. By omitting business and gift and estate tax matters, there is more space for in-depth discussions of family law topics. Family Tax Law contains the text of every section of the Internal Revenue Code necessary to understand the family law issue being discussed. It will not be necessary for students to purchase a separate supplementary code book. About the author: Prior to becoming a full-time law professor in 1990 at Capital University Law School in Columbus, Ohio, Professor Wood spent 10 years with the IRS Office of Chief Counsel in Washington, D.C. In 1988, Wood was selected as one of three attorneys in the Office of Chief Counsel assigned to be visiting professors of law at an American law school. Professor Wood teaches tax law courses including, federal personal income tax and family tax law, as well as courses in business associations, and has published articles on various tax subjects in leading law reviews. Professor Wood speaks regularly on the tax implications of adoption at Adoption Academy programs presented by the National Center for Adoption Law and Policy. Early in his career Wood worked with the San Francisco non-profit law firm Gay Rights Advocates where he participated in their efforts to defeat the Briggs Initiative. Professor Wood received his undergraduate degree from the University of Kentucky, his J.D. from The Ohio State University Moritz College of Law and his LLM (Taxation) from Georgetown University Law Center.
